Privacy policy

This Personal Data Processing Policy (the "Policy") applies to all information that the http://bit-tech.io Site, located on the domain name of the http://bit-tech.io, may receive about the User while using the Site, its programs and products.

 

1. TERMS

Site - software that provides the User with the opportunity to access the Company's products.

Company/Site Administration - domain owner or authorized persons who organize and (or) process personal data, and also determine the purposes of processing personal data, the composition of personal data to be processed, actions (operations) performed with personal data.

Personal Data - any information related directly or indirectly to a certain or defined User as a subject of personal data.

Personal data processing - any action (operation) or a set of actions (operations) performed using automation means or without using such means with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.

Confidentiality of personal data is a mandatory requirement for a person authorized to access the User's personal data not to allow their distribution without his consent, expressly expressed in writing or other legal basis.

Site User - an individual or a legally authorized representative of the User - a legal entity, who has sent in the proposed form of the Site Administration an Application for free demo access to the Site via the Internet based on Authentication Data.

Authentication data - a unique login (login) and password (password) registered by the Site Administration, allowing to identify the User and used for access (demo access) to the Site options.

Authorization - the process of analyzing the authentication data entered by the User in the form of a combination of login and password, the results of which determine whether the User has the right to access (demo access) to the Site options.

User Account - the user interface of the Site software provided to the User, which allows you to use the functions and options of the Site.

 

2. GENERAL PROVISIONS

2.1. Sending an application by the User for demo access to the Site options and (or) a request for presentations on the solutions offered by the Site means consent to this Policy and the terms of processing of the User's personal data.

2.2. In case of disagreement with the terms of the Policy, the User must stop using the Site.

2.3. This Policy applies only to the Site. The Site Administration does not control and is not responsible for the sites of third parties to which the User can follow the links that may be available on the Site, as well as for the information posted by the User in his own account.

2.4. The Site Administration does not check the accuracy of the information provided by the Site User. However, the User guarantees that, upon request, he provided the Site Administration with reliable data.

2.5. The user who has access to the account has the right to use the Site options at its own discretion. The use of the Site is limited by the User's obligation not to reproduce, repeat or copy, sell or assign, as well as not to use for any commercial purposes any elements of the Site software, as well as not to transfer to third parties the right to use the Site or access it.

2.6. The Site Administration has the right to initiate a one-time change of the User's Authentication Data (for example, when changing the authorized representative of the User - a legal entity or terminating the term of such powers) or with a certain frequency (for example, in order to increase the level of security).

2.7. This Policy is non-commercial in nature and does not constitute a basis for cash settlements or transfer of other tangible assets. The User undertakes not to use trademarks related to the Site and decisions of the Company, the description of which is posted on the Site. The provisions of the legislation on consumer protection are not subject to application.

2.8. The Site Administration has the right to use the cookie technology to store information about the IP address of the Site Visitor. This technology is not used by the Site Administration to preserve confidential information about the Site Visitor, and is not aimed at establishing the identity of the Site Visitor. All information that is collected and analyzed is anonymous.

2.8.1. The use of this technology is the placement on the Site of a certain set of characters (characters) that are stored on any device from which the User has logged into the Site, when accessing certain places on the Site.

2.8.2. Cookie technology is used to:

- collecting statistical data on the activity of Users on the Site;

- increase of productivity and efficiency of the Site;

- analysis and correction of Site errors, improvement of all Site resources;

- safety and integrity of the Site resources

2.9. The Software of the Site is provided to the User in the form in which it exists, without any guarantees. The Site Administration shall not be liable for damage or losses of the User or third parties related to the use of the Site contrary to the terms of this Policy.

 

3. POLICY SUBJECT

3.1. This Policy establishes the obligations of the Site Administration to non-disclosure and ensure the protection of personal data of the User, which can be obtained by the Site Administration at any time of its use.

3.1.1. At the time of approval of the current version of this Policy, the following data are personal data of the User:

- name, phone number, e-mail of the User;

- a set of unique login and password values ​ ​ generated by the Site Administration to provide demo access to the Site options.

3.1.2. If in order to obtain access rights to the Site, additional information about Users is required, which is subject to the criteria of personal data, the Site Administration approves the new version of the Policy and places the current version on the Site.

3.5. Ensuring proper access of the User to the Site is a sequence of the following actions by the User:

- connection to the Site via the Internet is established from any device used by the User to obtain demo access

- access by the User is carried out exclusively at the Site address

- The user does not use someone else's device

- The user has provided antivirus security of the device from which the account is logged in

- access to the User's account is carried out solely for the purpose of obtaining demo access to the Company's solutions, excluding illegal actions that entail harm to an unlimited number of persons

- in the process of open access to the account, the User will not take any actions aimed at:

• disruption of normal functioning of the Site equipment and software,

• to allow any changes to the Site software on its own and/or with the involvement of third parties,

• to use any means of automated access to the User's account

3.6. When using the Site, the User may not:

- upload, send, transmit or in any other way post and/or distribute content that is illegal

- violate the rights of third parties and/or harm them in any form

- impersonate another User without sufficient rights, as employees of the Site Administration, as the owner of the Site, as well as use any other forms and methods of illegal representation of other persons on the network, as well as mislead other Users or the Site Administration regarding the functions and options of the Site;

- upload, send, transmit or in any other way post and/or distribute content through the User's account, if there are no rights to such actions in accordance with the law or any contractual relations;

- collect and store personal data of other persons in the Website account without authorization;

- disrupt the normal operation of the Site.

3.7. The User shall independently be responsible for compliance of the content of text and graphic information posted by the User in the account with the requirements of the current legislation, including liability to third parties in cases where the User's posting of this or that information or its content violates the rights and legitimate interests of third parties and/or encroaches on their intangible benefits.

3.8. The User acknowledges and agrees that the Site Administration has the right to moderate any information posted and/or distributed by the User through the Site options, as well as that the Site Administration has the right, at its discretion, to refuse to post and/or disseminate information to the User or delete any information that is available in the User's account. The user realizes and agrees that he must independently assess all risks associated with the use of information, including an assessment of its reliability, completeness or legality.

 

4. PURPOSES OF COLLECTING AND PROCESSING USER PERSONAL DATA

4.1. Collection and Processing of the User's personal data shall be performed in order to:

4.1.1. authorization of the User on the Site, as well as receipt by the User of access (demo access) to the functions and options of the Site;

4.1.2. processing of the User's application for presentation of solutions offered by the Operator via the Site.

 

5. METHODS AND TERMS OF PERSONAL INFORMATION PROCESSING

5.1. Personal data of the User are subject to storage, processing and use by the Site Administration only as long as they are necessary to achieve the purpose (s) for which they were collected, and as required by applicable law. This means that these actions with personal data can be carried out by the Site Administration throughout the lifetime of the User's account, unless there are legal grounds to store them for a longer period of time. Processing of the User's personal data is carried out in any legal way, including in personal data information systems using automation means or without using such means.

5.2. Personal data of the User may be transferred to the authorized state authorities of the Russian Federation only on the grounds and in the manner established by the legislation of the Russian Federation.

5.3. The site administration takes the necessary organizational and technical measures to protect the User's personal information from illegal or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions of third parties. The Site Administration restricts access to the personal data of the User exclusively to the circle of persons who need it to process data on behalf of the Site Administration.

In cases where such persons are employees of the Site Administration, they are bound by confidentiality agreements, and the Site Administration will take appropriate action if it turns out that the employee (s) of the Site Administration did not comply with the standards for ensuring the security of User personal data.

5.4. The Site Administration is obliged to use the User's personal data exclusively for the purposes specified in clause 4 of this Policy, to ensure their storage and non-disclosure without the User's prior written permission, and also not to sell, exchange, publish, or disclose the User's personal data by other possible means, except for clauses 5.2. of this Privacy Policy.

 

6. LIABILITY OF THE PARTIES

6.1. The user is responsible for the safety of the login and password provided by the Site Administration both in aggregate and separately.

6.2. The Site Administration shall be liable for non-fulfillment or improper fulfillment of this Policy only in the presence of fault.

6.3. In case of loss or disclosure of personal data of the User, the Site Administration is not responsible if this data:

- became public before their loss or disclosure, including through the fault of the User.

- were disclosed by the Site Administration with the User's consent.

6.4. The administration of the Site is exempted from liability in case of deliberate disclosure of personal data by the User or his employees, as well as in case of illegal disposal of such data from the possession of the User due to violation of security standards by the User and/or his employees.

6.5. The administration of the Site is not liable for damage to third parties in a situation where access to the Site has become possible for unauthorized persons due to the unlawful disposal of personal data from the possession of the User.

 

7. DISPUTE RESOLUTION

7.1. In the event of disputes arising from the legal relations of the Parties regarding the use of personal data, the Party whose rights are violated is obliged to send a claim, the period for consideration of which and preparation of a reasoned response is 15 calendar days from the date of receipt by the Party whose actions are disputed such a claim. If the agreement is not reached, the Parties shall have the right to apply to the court in accordance with the procedure established by the current legislation of the Russian Federation.

7.2. The current legislation of the Russian Federation applies to this Privacy Policy and the relationship between the User and the Site Administration.

8. ADDITIONAL CONDITIONS

8.1. The site administration has the right to make changes to this Policy without the consent of the User.

8.2. The new Policy comes into force from the moment of its posting on the Site, unless otherwise provided by the new version of the Policy.
